ITIN Expired? The 3-Year Rule and How to Renew It
Unlike an EIN, an ITIN genuinely does expire — if it's unused on a federal tax return for 3 consecutive years. The exact rule, who needs to renew, and who doesn't.
Published by HynoGo — US LLC & UK LTD Formation for Non-Residents — From Anywhere.. Dedicated corporate formation, international taxation, and business compliance intelligence for cross-border founders.
Quick answer
An ITIN expires if it is not used on a US federal tax return for three consecutive tax years. Renew it with Form W-7 before you file again, because filing with an expired ITIN can delay refunds and credits.
The 3-year rule, exactly as the IRS states it
Unlike an EIN, an Individual Taxpayer Identification Number genuinely does expire: if your ITIN isn't included on a US federal tax return for any 3 consecutive tax years, it expires on December 31 following that third year of non-use. For example, an ITIN not used on a return filed for 2023, 2024, or 2025 expires on December 31, 2026.
Who actually needs to renew — and who doesn't
The renewal requirement is narrower than most people assume. You need to renew your ITIN only if you'll include it on a federal tax return going forward. If your ITIN is used exclusively for information returns — most commonly a Form 1099 reporting payments you've received — you do not need to renew it; expired ITINs can continue being used on information returns without issue.
This distinction matters for non-resident founders specifically: if your ITIN only ever appears on 1099s from a platform or client, expiration may be a non-event for you — but if you personally file a US tax return (common for ITIN holders with US-source personal income), you need it active.
What happens if you file with an expired ITIN
Filing a federal tax return with an expired ITIN doesn't stop your return from being accepted, but it does create real friction: processing is delayed, certain tax credits may become unavailable to you until the ITIN is renewed, and the combination can reduce your refund or result in penalties and interest on any balance due.
How to renew
Renewal uses the same Form W-7 as a new application, marked as a renewal rather than a new request, along with the identity and foreign-status documentation the IRS requires. Using a Certifying Acceptance Agent (CAA) for this step means your original passport doesn't need to be mailed to the IRS — the CAA verifies your identity documents directly and certifies the application.
How HynoGo helps
HynoGo's certified ITIN service handles both new applications and renewals through IRS Certifying Acceptance Agent review, so you're not mailing your original passport internationally either way — and we can help you determine whether your specific ITIN usage actually requires renewal before you file.
