PayPal 1099-K Threshold & W-8BEN-E for Non-Residents
The current IRS 1099-K reporting threshold for PayPal and other payment platforms, and why non-resident LLC owners need Form W-8BEN-E even when no US tax is owed.

Quick answer
For 2026 the Form 1099-K threshold is $20,000 in gross payments and more than 200 transactions. Non-US business owners generally give PayPal a Form W-8BEN or W-8BEN-E to certify foreign status instead of receiving US tax reporting on their account.
The current 1099-K threshold: $20,000 and 200 transactions
As of the One, Big, Beautiful Bill (OBBB), the IRS reporting threshold for Form 1099-K reverted to $20,000 in gross payments and more than 200 transactions in a calendar year — the threshold that was in effect before the temporary American Rescue Plan Act (ARPA) changes. This applies to third-party settlement organizations like PayPal, Stripe, and similar platforms reporting payments for goods and services.
Below that combined threshold, PayPal is not required to issue you a Form 1099-K — but you may still receive one voluntarily, and the lack of a 1099-K never removes your underlying obligation to report actual income earned.
One narrow exception: payment-card transactions (direct card processing rather than a peer-to-peer style payment network) can trigger a 1099-K with no minimum threshold at all — even $0.01 technically qualifies under that specific rule.
Why a 1099-K doesn't automatically mean US tax is owed
Receiving a Form 1099-K is an information-reporting event, not a tax bill. For a non-resident-owned single-member LLC operating as a pass-through 'disregarded entity' with no US office, staff, or dependent agents (non-ETBUS status), foreign-source business income is generally not subject to US federal income tax — regardless of how much shows up on a 1099-K. What the LLC still owes is the correct annual informational filing (IRS Form 5472 attached to a pro-forma Form 1120) disclosing the activity.
What Form W-8BEN-E actually does
Form W-8BEN-E is the certificate a foreign (non-US) entity files to establish its foreign status to a US payer or platform — it is the entity-level counterpart to the individual Form W-8BEN. Filing it correctly does two things: it certifies to PayPal (or any US payer) that your LLC is foreign-owned for withholding purposes, and in most cases it prevents the default 24–30% backup withholding that payers must otherwise apply when they can't confirm a payee's tax status.
A single-member LLC classified as a disregarded entity is a special case — in some contexts the platform may ask for the owner's individual W-8BEN instead of the entity's W-8BEN-E, since a disregarded entity's income flows up to its foreign owner for US tax purposes. The correct form depends on how the specific platform's compliance system is configured; when in doubt, provide your EIN and LLC details and let the platform's own onboarding flow specify which form it requires.
Keeping your 1099-K and your Form 5472 filing consistent
If PayPal (or Stripe, or any platform) issues you a 1099-K, that figure becomes a data point the IRS already has on file. It's worth making sure the gross payment volume reported on any 1099-Ks you receive is accounted for — even if untaxed — in your LLC's records, so there's a clear, consistent paper trail if the IRS ever cross-references the two.
How HynoGo helps
HynoGo's formation packages include your official IRS EIN confirmation letter, which is the document you'll need on hand to complete W-8BEN-E correctly, and our compliance guidance covers the annual Form 5472 / pro-forma 1120 filing that keeps your LLC in good standing regardless of what any platform reports on a 1099-K.
